Welcome to Move It Mama!

These Terms and Conditions (“Terms”) apply to your use of the Move It Mama website, mobile applications (iOS and Android), and any related services provided by Move It Mama Ltd (“Move It Mama”, “we”, “us”, “our”). By accessing or using our services (“the Service”), you agree to these Terms. Please read them carefully before using the Service.

1. Overview

Move It Mama provides online fitness and wellbeing content, including live and recorded workouts, community interaction, and other related resources.

You may access the Service through our website at www.moveitmama.co.nz or via our mobile app available on the Apple App Store and Google Play Store.

If you do not agree to these Terms, you must not use the Service.

2. Memberships, Payments and Billing

2.1 Membership Options

You can access Move It Mama content through a paid subscription, known as a “membership”.

Memberships may be purchased either:

  • (a) via our website, with payments processed securely through Stripe, managed by RevenueCat; or

  • (b) via the Move It Mama mobile app, in which case billing is handled by the Apple App Store or Google Play Store.

Both options provide access to the same content and features; however, membership management and cancellation differ depending on where you signed up.

2.2 Website Memberships (Stripe/RevenueCat)

If you sign up through our website:

Payments are processed by Stripe and managed via RevenueCat.

  • You authorise recurring charges to your nominated payment method until you cancel.

  • You may cancel your membership anytime through your online account.

  • When you cancel, access continues until the end of your current billing period. No partial refunds are provided unless required by New Zealand law.

2.3 In-App Memberships (App Store/Google Play)

If you sign up through the iOS or Android app:

  • Your payment and renewal are managed entirely by Apple or Google.

  • Your membership is linked to your App Store or Google Play account.

  • You must manage or cancel your membership through your store account settings.

  • Refunds are subject to each store’s policies.

  • Move It Mama cannot process cancellations or refunds for in-app purchases on your behalf.

2.4 Auto-Renewal

All memberships automatically renew at the end of each billing cycle unless cancelled at least 24 hours before the renewal date. Renewal pricing remains the same unless otherwise notified.

2.5 Price Changes

We may update pricing from time to time by notifying you by email, website notice, or in-app notification.

For website memberships, changes take effect at your next renewal following notice.

For in-app memberships, Apple or Google will notify you and may require consent to the new price before renewal.

If you do not accept the price changes, you may terminate your membership before your next renewal. 

2.6 Trials and Promotions

Any free trial or promotional offer automatically converts to a paid membership at the end of the trial period unless cancelled before that time.

2.7 Taxes

All prices include GST (where applicable). Any taxes or fees imposed by app-store providers are outside our control.

3. Use of the Website, App and Service

3.1 Eligibility

You must be 16 years or older to hold a Move It Mama membership. By using the Service, you confirm that you meet this age requirement. If you are under 18, you confirm that you have the consent of your parent or legal guardian to form this contract.

3.2 Account Security

You are responsible for maintaining the confidentiality of your login details. You must not share your account or membership with others or allow unauthorised use.

Notify us immediately if you suspect any unauthorised access.

3.3 App Device Permissions and Notifications

The app may request access to certain device features (e.g. camera, microphone, health data, push notifications). You can grant or deny permissions within your device settings. Denying permissions may disable some features.

By installing the app, you agree to receive push notifications and in-app alerts, which you may opt out of at any time.

3.4 Updates and Maintenance

We may release app updates or enhancements periodically. You agree to install the latest version to ensure proper functionality. Older versions may become unsupported without prior notice.

3.5 Offline Use and Caching

Some content may be cached locally on your device for offline access. Offline content may not always sync correctly, and we are not responsible for data loss or inconsistencies caused by offline usage.

4. Acceptable Use and Prohibited Conduct

You must not:

  • copy, distribute or modify the Service, website, app or any of their content without permission;

  • reverse-engineer or tamper with any part of the Service;

  • use the app on a jailbroken or rooted device to circumvent restrictions;

  • upload or share unlawful, harmful, or infringing material to the app or website; or

  • attempt to access accounts or systems without authorisation.

We reserve the right to suspend or terminate your membership for any misuse or breach of these Terms.

5. Intellectual Property

All content, trade marks, logos, and designs within the Service remain the property of Move It Mama or its licensors.

Your membership grants a limited, non-exclusive, non-transferable licence to access and view content for personal, non-commercial use only.

By submitting any content through the Move it Mama platform (“User Content”), the user grants Move it Mama a worldwide, royalty-free, non-exclusive, transferable licence to use, reproduce, modify, display, distribute, and create derivative works from that content for the operation and enhancement of the platform.

Move it Mama may access, monitor, or review User Content at any time and may remove or restrict any content at its sole discretion without prior notice.

The user warrants that they hold all necessary rights to any User Content they submit and that such content does not infringe the intellectual property or privacy rights of any third party.

6. Health Disclaimer

Always consult your doctor before beginning any fitness programme. Our workouts and content are intended for general guidance and motivation, not as medical advice. By participating, you accept full responsibility for your health and any risks associated with exercise.

7. Privacy

We may collect personal information from you:

  • in the course of providing our Services to you;

  • when you communicate or interact with us; and

  • through your use of our website or app.

The types of personal information generally collected by us may include your name, contact information and billing or purchase information. If you choose not to provide such information, we may not be able to provide the Service to you. 

We may share this information with third party service providers to Move It Mama, for the purpose of providing the Service, website or app to you. Third party service providers may have access to information to perform their functions, but may not use information for their own purposes. 

We take reasonable steps to keep your personal information secure and confidential. 

You have the right to ask for a copy of any personal information we hold about you, and to ask for it to be corrected if you think it is wrong. If you would like to ask for a copy of your information, or to have it corrected, please contact us at subscriptions@moveitmama.co.nz.

8. Third-Party Services and Integrations

The Service may use third-party tools such as RevenueCat, Stripe, analytics platforms, and social-media integrations.

These parties may process data in accordance with their own privacy policies.

We are not responsible for the availability or performance of third-party services.

8. Termination and Suspension

We may suspend or terminate your membership or access to the Service if:

  • you breach these Terms;

  • you misuse the Service; or

  • required by law or platform policy.

Upon termination, your right to use the Service stops immediately, but clauses relating to disclaimers, liability, intellectual property, and dispute resolution survive.

9. Changes to Terms

We may update these Terms occasionally. When changes are made, we will notify you by email, website notice, or in-app notification.

Continued use of the Service after the effective date of any changes constitutes acceptance of the new Terms.

10. Disclaimer and Limitation of Liability

To the fullest extent permitted by law:

  • the Service is provided “as is” without warranties of any kind (and any implied condition or warranty, including any warranty under the New Zealand Contract and Consumer Law Ac 2017, is excluded);

  • where circumstances arise, we reserve the right to vary the schedule for, or the number of, workouts or content from time to time; 

  • we are not liable for any loss arising from downtime, device incompatibility, or third-party failures;

  • we are not liable for any indirect, consequential, incidental or special loss or damage of any kind;

  • our maximum total liability under or in connection with these Terms or your use of the Service, whether in contract, tort (including negligence), breach of statutory duty or otherwise is limited to the amount paid by you for the Service in your most recent payment period.

Nothing in these Terms limits your statutory rights under the New Zealand Consumer Guarantees Act 1993 or other applicable laws.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of New Zealand.

You agree to the exclusive jurisdiction of the New Zealand courts in relation to any dispute arising from these Terms or your use of the Service.
